FOIL Requests
Freedom of Information Law (FOIL)
New York State’s Freedom of Information Law (Public Officers Law §87 et; seq;) permits members of the public to access records of governmental agencies, including Boards of Cooperative Educational Services. This law provides a process by which members of the public may review and/or receive copies of the agency’s records. The Committee on Open Government, a unit housed within the Department of State, is responsible for overseeing and advising interested parties on FOIL.
Submitting Requests for Records
Requests for access to Erie 2-Chautauqua-Cattaraugus BOCES’s records may be submitted to the Records Access Officer via email at RecordsAccessOfficer@e2ccb.org or postal mail at the following address:

In addition, requests can be made in person most business days (Monday through Friday) from 8 a.m. to 4 p.m. at the above-listed address, or utilize the form located at the bottom of this page.
Fee for Duplication of Records
Erie 2-Chautauqua-Cattaraugus BOCES charges the statutorily permitted fee of $.25 per page for photocopies of records requested under FOIL (Public Officers Law §87[1][b][iii]). Additional copy preparation fees may apply as permitted by law. There is no provision in law or regulation requiring a waiver of this fee. Payment must be made to Erie 2-Chautauqua-Cattaraugus BOCES by check or money order. Payment should not be submitted until you are notified that your request is granted and informed of the charge for your request.
Submitting a FOIL Appeal
Any person denied access to a record may appeal within 30 days by emailing dorourke@e2ccb.org or writing to: David O’Rourke, District Superintendent, Erie 2-Chautauqua-Cattaraugus BOCES, 8685 Erie Road, Angola, NY 14006.
FOIL Appeal Procedures
Pursuant to New York Public Officers Law §89(4) within ten business days of the receipt of a FOIL appeal an agency shall “fully explain in writing to the person requesting the record the reasons for further denial, or provide access to the record sought;” Failure by an agency to provide such a determination shall constitute a denial. A person denied access to a record in a FOIL appeal determination may bring a proceeding for review of such denial pursuant to article seventy-eight of the civil practice law and rules.
